Terms of Service

These Terms of Service form a binding agreement between you and TheoryCraft, the operator of HabitScaler. By downloading, accessing, purchasing, or using HabitScaler, you agree to these Terms and the Privacy Policy.

HabitScaler provides local habit-planning and progress-tracking tools, scaled targets, projections, reminders, history, share cards, and shareable plan links. Features can vary by platform, app version, storefront, device, and purchase status.

HabitScaler does not require a HabitScaler account for normal app use. Habit names, targets, logs, reminders, and profile settings are primarily stored on your device, subject to device-backup settings described in the Privacy Policy.

You retain responsibility for the habit names, goals, progress records, images, and other content you create or share. You confirm that you have the rights needed for anything you choose to distribute through a share sheet or shared plan link.

A shared plan link contains its configuration in the URL. Anyone who receives the link can read and import that configuration, so you should not include sensitive information in a plan you share.

HabitScaler provides planning, calculation, reminder, and tracking tools. It does not provide medical, psychological, nutritional, legal, financial, or other professional advice, diagnosis, or treatment.

Projections are estimates based on the information and schedule you enter. You are responsible for choosing goals that are appropriate for your health, circumstances, and applicable law, and for seeking qualified advice when needed.

HabitScaler Pro can be unlocked through an active subscription or a lifetime purchase. The features included in Pro are described in the app and can evolve as HabitScaler is improved.

Purchase availability, price, currency, taxes, billing interval, and any introductory offer are displayed by Google Play or Apple App Store before you confirm a purchase. Storefront information shown at purchase controls if it differs from a general description in these Terms.

The monthly subscription includes a 7-day free trial when the applicable storefront displays that offer and confirms your eligibility. Unless you cancel before the trial ends, the subscription begins and the store charges the payment method associated with your store account.

A subscription renews automatically for successive billing periods at the price displayed by the store unless you cancel through your store-account subscription settings before renewal. Deleting or uninstalling the app does not cancel a subscription.

After cancellation, paid access normally continues until the end of the current trial or paid billing period, subject to the applicable store's rules.

A lifetime purchase is a one-time, non-consumable in-app purchase that unlocks the then-supported HabitScaler Pro features for the store account associated with that purchase, subject to storefront availability, restoration support, and these Terms.

The applicable app store processes payment methods, charges, renewals, cancellations, tax collection, receipts, and refund requests under its own terms and refund rules. Mandatory consumer rights and remedies remain unaffected.

HabitScaler includes Restore purchases to request current entitlement information for the store account. Restoring a purchase restores eligible paid access; it does not restore local habit data that was not included in a device backup.

You may not use HabitScaler, its public website, or shared links to break applicable law, infringe another person's rights, distribute malicious or unlawful material, probe or bypass security controls, interfere with the service, or obtain paid access without authorization.

HabitScaler depends on services provided by Google Play, Apple App Store, RevenueCat, platform backup providers, and Hetzner. Your use of those services is also subject to their applicable terms and privacy practices.

We do not control third-party availability, storefront decisions, payment processing, backup restoration, platform policies, or service changes.

HabitScaler is provided on an “as is” and “as available” basis. We work to keep the application and public website reliable and secure, but do not guarantee uninterrupted, error-free, or perpetual availability.

We may add, change, or discontinue features to improve the product, maintain security, comply with law, or respond to platform requirements. We will provide reasonable notice when a material change adversely affects paid access where notice is practicable.

HabitScaler and its software, interface, documentation, calculations, and original materials are owned by TheoryCraft or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use HabitScaler for its intended purpose.

To the fullest extent permitted by law, TheoryCraft disclaims implied warranties relating to HabitScaler and is not responsible for decisions made from projections, missed reminders, lost local data, device-backup failures, or third-party service failures.

To the fullest extent permitted by law, TheoryCraft is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or opportunity. TheoryCraft's aggregate liability arising from HabitScaler will not exceed the amount you paid for HabitScaler during the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes warranties, remedies, rights, or liability that applicable law does not allow to be excluded or limited.

These Terms are governed by French law, without regard to conflict-of-law rules. Courts with jurisdiction under applicable law may hear disputes. Mandatory consumer protections and jurisdiction rights remain unaffected.

We may update these Terms. The date at the top identifies the current version. Material changes will be communicated through the application, public website, storefront listing, or another appropriate channel. Changes apply prospectively from their stated effective date.
